UOKiK round table – social media ads

Acting in cooperation with representatives of four state institutions, the President of UOKiK has held talks with the following social media platforms: Meta, Google and TikTok. The roundtable meeting that was also attended by representatives of the advertising industry and the academia, focused on quicker and more effective elimination of illegal advertising. The event was another step towards more efficient management of the social media advertising market.

Today CJEU has issued a judgment whereunder a court may find a contractual provision unfair only because it is identical to the provision entered in the register of abusive clauses. A contractual provision may not be deemed unfair towards a part of the consumers who have concluded the agreement and fair towards other ones. A bank is also obliged to inform all borrowers of some material characteristics of the agreement as well as risks related to it even if a consumer has relevant knowledge in the scope of agreement conclusion.

Conscious consumer since the earliest age – the Kindergartner Day with UOKiK

Nearly 10,000 children have already taken part from classes in kindergartens under the UOKiK’s “ABC of the Young Consumer” project. Lesson plans are one of the educational aids available free of charge at malykonsument.uokik.gov.pl. Online games designed for children are also prepared: “Store memo” and “Doing shopping” - by way of games they teach wise consumer choices, allow to practice memory and perceptiveness. Anyone can use the materials at home. We would like to remind you that kindergartens can also still apply to participate in the project.

The President of UOKiK has brought charges of infringing the collective interests of consumers against the Centrum Medyczne Telmed company based in Lublin. Users of the websites: e-lekarz24h.pl and e-zwolnienie24h.pl may be misled regarding the possibility of obtaining a prescription for certain medications, the authenticity of opinions about services and the right to withdraw from the contract. The entrepreneur faces a fine of up to 10 percent of its turnover

An entrepreneur or a natural person not conducting business activity? Who sells on the platform and what are the ensuing rights for consumers? What is the segregation of duties between the platform and the seller? President of UOKiK checks if consumers are properly notified on issues arising from the Omnibus Directive. Following his intervention, a number of entrepreneurs have aligned or started to change their practices. Zalando, Booking, Travelist have already had charges pressed - they are at risk of a fine of up to 10 percent of their turnover.

The pyramid-like incentive schemes promise their participants some benefits which first and foremost are dependent on the introduction of subsequent persons into the system. UOKIK has been investigating whether platforms such as: iGenius, Dream Trips and Jifu had violated consumer collective interests.

President of UOKiK Tomasz Chróstny has imposed a fine totaling over 5 million PLN for improper tagging of advertising materials on social media.Decisions relate to Olimp Laboratories, one of the leaders in the dietary supplement industry, and three influencers from the fitness industry.These are first fines imposed both on the authors and on the advertiser for improper tagging of advertising content.
